1. Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of Rolevate's website, applications, and services, including our interview platform and related features (collectively, the "Service"). By accessing or using our Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use the Service.

We may modify these Terms at any time. If we do so, we will notify you by updating the "Last Updated" date at the top of these Terms. Your continued use of the Service after any changes constitutes your acceptance of the revised Terms.

2. Eligibility

You must be at least 18 years old to use our Service. By using our Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

3. Account Registration and Security

You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4.1 Interview Conduct and Recordings

When participating in interviews through our Service, you agree to:

• Behave professionally and respectfully
• Not share confidential information of third parties
• Not engage in discriminatory, harassing, or offensive behavior
• Not record interviews using external tools unless explicitly authorized

Consent to Recording: By participating in interviews through our Service, you acknowledge that interviews may be recorded for evaluation, quality assurance, and other purposes as outlined in our Privacy Policy. You will be notified before recording begins and may withdraw consent, although this may affect your ability to participate in certain interview processes.

Use of Recordings: Interview recordings may be shared with the hiring organization, their authorized representatives, and Rolevate staff as necessary to facilitate the hiring process. Recordings will not be used for marketing purposes without your explicit consent.

4.2 WhatsApp Communications

If you opt to communicate with us via WhatsApp:

• You consent to receive messages through WhatsApp related to our Service
• You acknowledge that your use of WhatsApp is also subject to WhatsApp's own Terms of Service
• You may opt out of WhatsApp communications at any time by replying "STOP" or "UNSUBSCRIBE"
• You understand that standard messaging rates from your mobile carrier may apply

WhatsApp Business API Usage: Our use of WhatsApp Business API complies with WhatsApp's Business Policy. We do not use WhatsApp data for advertising purposes and maintain appropriate security measures to protect your information.

5. Intellectual Property Rights

The Service and its original content, features, and functionality are owned by Rolevate and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, and revocable license to access and use the Service for its intended purposes.

5.1 User Content

"User Content" refers to any information, data, or materials you submit through the Service, including but not limited to profile information, resumes/CVs, interview responses, and messages.

By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, store, display, reproduce, save, modify, create derivative works, perform, and distribute your User Content for purposes of operating, developing, providing, and improving the Service and as permitted in our Privacy Policy.

You represent and warrant that you own or have the necessary rights to your User Content and that it does not violate the rights of any third party or any applicable laws.

6. Third-Party Services and Links

Our Service may contain links to third-party websites or services that are not owned or controlled by Rolevate. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites or services.

Your interactions with third-party services are solely between you and the third party. We encourage you to review the terms and privacy policies of every third-party service you visit.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

WE DO NOT GUARANTEE THE ACCURACY, COMPLETENESS, OR USEFULNESS OF ANY INFORMATION PROVIDED THROUGH THE SERVICE OR THAT YOU WILL OBTAIN EMPLOYMENT OR ANY OTHER DESIRED OUTCOME FROM USING OUR SERVICE.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ROLEVATE, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE;
• ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE;
• ANY CONTENT OBTAINED FROM THE SERVICE; AND

You agree to defend, indemnify, and hold harmless Rolevate, its directors, employees, partners, agents, contractors, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service, including, but not limited to, your User Content, any use of the Service's content, services, and products other than as expressly authorized in these Terms.

10. Term and Termination

These Terms shall remain in full force and effect while you use the Service. We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach the Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or contact us to request account deletion.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
